Scope &amp; hierarchy<\/b><\/h3><p>1.1. These Terms &amp; Conditions apply to every reservation\/rental of Ch\u00e2teau Guillermo, including all outbuildings, land and facilities.<\/p><p>1.2. Any specific provisions (offer, booking confirmation, Event Addendum) prevail over these Terms.<\/p><p>1.3. The Terms are available in NL\/FR\/EN; in case of conflict, the French version prevails.<\/p><h3><b>2. Booking, acceptance and communication<\/b><\/h3><p>2.1. A booking is only final and binding after written confirmation by the Lessor and once the full rental amount has been received, unless otherwise agreed in writing.<\/p><p>2.2. For direct bookings, the Tenant ticks: *\u201cI accept the General Terms &amp; Conditions and the Privacy Policy.\u201d* The system records name, date, time and IP address.<\/p><p>2.3. For platform bookings (Airbnb\/Booking etc.), the Tenant fills out a registration form including a link to the Terms &amp; Conditions and House Rules, and confirms acceptance.<\/p><p>2.4. For events, or where reasonably required, the Lessor may require a short rental contract\/addendum to be e-signed (e.g. DocuSign); failure to sign may result in cancellation.<\/p><h3><b>3. Price, deposit and balance<\/b><\/h3><p>3.1. Unless otherwise stated, the price includes accommodation and normal (fair-use) consumption of water\/electricity\/heating.<\/p><p>3.2. In principle the price must be paid in full; only then is the booking definitive. If otherwise agreed, a deposit of at least 30% may be accepted. The full balance is due no later than 90 days before arrival.<\/p><p>3.3. Late payment is considered a cancellation by the Tenant (art. 8).<\/p><h3><b>4. Security deposit \u2013 \u20ac750<\/b><\/h3><p>4.1. Tenant pays a deposit of \u20ac750 by card pre-authorisation or bank transfer no later than 14 days before arrival.<\/p><p>4.2. The deposit is not rent and is not a liability cap. All damages, costs and penalties remain fully recoverable from the Tenant.<\/p><p>4.3. Refund within 7\u201314 days after departure, minus any damages\/extra costs (with invoice or cost statement).<\/p><p>4.4. If damages exceed the deposit, Tenant authorises Lessor to (i) charge the card on file (Merchant-Initiated Transaction), and\/or (ii) issue an additional invoice payable within 7 days.<\/p><h3><b>5. Inventory, condition &amp; access<\/b><\/h3><p>5.1. The property condition is deemed correct at check-in unless reported with photos within 4 hours.<\/p><p>5.2. Lessor may reasonably access the property (with prior notice, or immediately in case of emergency) for maintenance, repair or lawful inspection.<\/p><h3><b>6. Use, capacity and visitors<\/b><\/h3><p>6.1. Max. occupancy: 15 overnight guests (incl. children\/babies). The number of adults\/children\/babies must always be declared. Names\/ages may be requested by the Lessor and must then be provided.<\/p><p>6.2. Day visitors are allowed until 22:00, subject to prior notice; total presence on the estate never &gt; 40.<\/p><p>6.3. Prohibited: exceeding capacity, subletting, tents\/campers, fireworks, trading, professional photoshoots\/filming without written consent.<\/p><p>6.4. Breach = serious default. Lessor may terminate the rental immediately without refund and require eviction.<\/p><p>Penalty: \u20ac250 per extra person per night, plus consequential damages.<\/p><p>6.5. Tenant is solely responsible for compliance with French occupancy laws. Lessor accepts no liability.<\/p><h3><b>7. House rules &amp; safety<\/b><\/h3><p>7.1. No smoking indoors. Penalty \u20ac250 + cleaning.<\/p><p>7.2. Noise: respect neighbours and law. No amplified outdoor music. Quiet hours 22:00\u201308:00. Noise sensors (decibel\/Minut) are installed; violations may lead to eviction and\/or deductions from the deposit.<\/p><p>7.3. Fireplace\/BBQ: only dry wood; never leave fire unattended; comply with fire safety.<\/p><p>7.4. Sauna &amp; hot tub: shower first; no oils\/soaps\/glitter; close cover; children under constant supervision. Misuse \u2192 min. \u20ac100 extra maintenance per unit.<\/p><p>7.5. Ponds\/grounds: at own risk; children supervised at all times.<\/p><p>7.6. EV charging: only via outdoor sockets declared in advance and billed at agreed rate. If undeclared \u2192 \u20ac100 minimum surcharge.<\/p><p>7.7. Waste: sorting mandatory; improper disposal charged.<\/p><p>7.8. Keys\/badges: loss \u20ac250 per set (incl. lock replacement).<\/p><p>7.9. Cleaning: final cleaning included; excessive dirt or unwashed dishes \u2192 \u20ac50\/hour (min. 2 h).<\/p><p>7.10. Pets: allowed if declared in advance, surcharge \u20ac15 per pet (future changes announced on website).<\/p><h3><b>8. Cancellation &amp; no-show (by Tenant)<\/b><\/h3><ul><li><p>Up to 60 days: refund 50% minus \u20ac75 admin fee.<\/p><\/li><li><p>59\u201345 days: refund 25%.<\/p><\/li><li><p>45 days or less \/ no-show \/ early departure: no refund<\/p><\/li><\/ul><p><i>Note:<\/i>services already delivered (linen, late check-out, etc.) are charged as per their conditions.<\/p><h3><b>9. Cancellation protection<\/b><\/h3><p>9.1. Optional protection: \u20ac250 fee \u2192 right to one-time rebooking within 12 months in case of serious unforeseen events (death of close relative, hospitalisation, major home damage). Excludes change of plans, weather, documents, work. Proof required within 7 days.<\/p><h3><b>10. Cancellation\/modification by Lessor<\/b><\/h3><p>10.1. In case of force majeure (art. 14) or unavailability: (i) rebooking or (ii) refund of amounts paid. No further damages owed.<\/p><h3><b>11. Theft, damage and liability<\/b><\/h3><p>11.1. Tenant fully liable for damage\/loss caused by themselves, guests or visitors, incl. consequential and admin costs.<\/p><p>11.2. Personal belongings are at Tenant\u2019s own risk; Lessor not liable for theft\/loss\/damage.<\/p><p>11.3. Lessor shall in no case be liable for personal injury or death, even if related to the property or grounds, except only where mandatory law or proven gross negligence of the Lessor expressly so requires.<\/p><p>11.4. Tenant must hold liability insurance (vill\u00e9giature); proof may be requested.<\/p><p>11.5. For events or extra visitors, Lessor may require: organiser liability insurance (RC organisateur) naming Ch\u00e2teau Guillermo as co-insured, plus higher deposit.<\/p><h3><b>12. Linen, extras and rates<\/b><\/h3><p>12.1. Unless stated: linen\/towels not included; sleeping without sheets prohibited.<\/p><p>12.2. Prices for extras (firewood, linen, wellness, late check-out, \u2026) on website; may change.<\/p><h3><b>13. Check-in\/out<\/b><\/h3><p>13.1. Check-in: from 16:00. Check-out: by 10:00.<\/p><p>13.2. Late check-out\/early check-in on request &amp; surcharge. Unauthorised late departure: \u20ac150\/hour.<\/p><h3><b>14. Force majeure<\/b><\/h3><p>14.1. Force majeure includes, among others, natural disasters\/floods, pandemic measures, fire, war\/terrorism, general power or internet outages, urgent government decisions.<\/p><p>14.2. The landlord is not liable for disturbances that are reasonably beyond his control (roadworks, utility disruptions by third parties, noise from third parties, weather conditions).<\/p><h3><b>15. CCTV &amp; privacy (GDPR)<\/b><\/h3><p>15.1. CCTV and noise sensors (Minut) may be active outdoors\/entrances for security and breach detection. No cameras indoors.<\/p><p>15.2. Basis: legitimate interest. Retention 30 days (longer if incident). Access limited to Lessor\/agents; may be shared with police\/insurers.<\/p><p>15.3. Controller: Van Riet Design SARL \u2013 Ch\u00e2teau Guillermo (info@chateau-guillermo.com). Rights: access, erasure, restriction, objection. Complaints: CNIL.<\/p><p>15.4. Website privacy\/cookies: see online privacy policy.<\/p><h3><b>16. Breach<\/b><\/h3><p>16.1. Breach of Terms\/House Rules = immediate termination, no refund, damages claim.<\/p><p>16.2. Invalid clause does not affect remainder.<\/p><h3><b>17. Governing law &amp; jurisdiction<\/b><\/h3><p>17.1. French law applies (subject to mandatory consumer law of Tenant\u2019s residence).<\/p><p>17.2. Disputes \u2192 competent French courts (Ardennes).
